SCHUFA has announced that it will store its data in the AWS European Sovereign Cloud [1]. The company emphasizes that the data will be processed “exclusively in Europe.” Just a few weeks earlier, the translation startup DeepL also switched to AWS. [2] Both are alarming developments: AWS is a subsidiary of Amazon and is therefore subject to U.S. law, which, among other things, requires it under the U.S. CLOUD Act to transfer data from European locations to U.S. authorities such as the NSA or CIA. SCHUFA is Germany’s largest credit bureau for economic data—and a private company.

Other technology providers, such as Microsoft, also cannot completely rule out granting U.S. authorities access to data stored in their sovereign EU clouds. This is evident from a sworn statement made by the chief legal counsel of Microsoft France during a hearing before the French Senate. A recent Bitkom survey also shows that 82% of German companies prefer digital solutions from Europe—a clear signal of greater trust in domestic providers.
